Multidistrict Litigation Set to Begin on Wednesday March 30, 2011 for Darvon Lawsuits

The wait is over for Darvon Lawsuit plaintiffs; on Wednesday March 30, 2011 the Judicial Panel on Multidistrict Litigation (JPML) will finally hear arguments on whether all Darvon and Darvocet Lawsuits should be centralized for pretrial litigation before a single federal judge.

A Multidistrict Litigation (MDL) is a tool often used for those who are seeking compensation for product liability, mainly because most of the similarities of the cases. A MDL also a good tool for the courts to avoid inconsistent rulings and discovery and conserving the resources of the parties involved. Xanodyne Pharmaceuticals, distributor of both Darvon and Darvocet, is lobbying that an MDL does not take place, claiming that there are several forms of propoxyphene drugs and each case depends on the patients overall health.

One of the first petitions for a MDL of Fixodent lawsuit was filed last December by a New York resident Kristine Esposito, this petition called for MDL for all federal lawsuits related to the recalled prescription drug propoxyphene, the main active ingredient in a number of popular painkillers, including Darvon and Darvocet. This case has been filed in the U.S. District Court for the Eastern District of New York. The petition for MDL has also caused several other cases to propose that the MDL be held in Eastern District of Louisiana or the Western District of Louisiana.

These cases all stem from the recall of all propoxyphene drugs by the FDA last November after an independent study by Xanodyne revealed that propoxyphene can cause cardiac abnormalities in patients with no previous heart problems. Since the ban the number of Darvon Lawsuits against Xanodyne and other propoxyphene linked companies have grown greatly in number. Many who have been injured blame the FDA for taking too long to ban propoxyphene, other blame the drug companies who still allowed the drug to stay on the market.

The findings of the JPML are highly awaited by thousands of people affected by Darvon and Darvocet, and any updates on the findings will be posted as soon as they are made available.
